Our insurance company is obligated to pay all amounts that a member notary may become “legally obligated to pay as Loss and Claims Expenses [that is, lawyers fees]” based upon any “alleged act, error omission” in the performance of “professional services as a notary public for others for a fee.”

The policy does not cover intentional wrongdoing, fraud, dishonesty or criminal acts by a member notary.  It also does not cover amounts payable as fines, taxes, or punitive damages.

Our insurance company has “the sole right to appoint defense counsel and the right and duty to defend any claim made” against a member notary.

Each member of the American Council of Notaries is provided with a certificate of insurance from our insurance company showing the terms and amount of coverage.
